Changes in real estate business: an apartment purchase and sale ticket from a well is considered an act

When publishing Decree 962/2018 in an official newspaper, the National Government introduces two major amendments to the Real Estate Register Act: now they can register purchase tickets from embedded houses from the well, and to do this, the parties will not need a notary if they will have access to a digital signature system supported by the Ministry of Modernization.

This new procedure, albeit beginning with the CABA, has been developed for the whole country, as is clear from the considerations of the new norm, and aims at the fact that those who buy property from a well have legal protection as if they had acted and, on the other hand, access to mortgage loans.

"We believe this is a positive tool for solving one of the most controversial aspects of access to finance for the purchase of assets with a family destination. Today, buying a house in the good, there is no credit, and it hurts investors as well as tenants who want to become for the owners, "said Alejandro Bennazar, President of the Real Estate Chamber of Argentina.

Another condition that appears in the official decree is that the buyer must pay at least 25% of the total price and the purchase ticket must be digitally signed by the parties, and Introduces Remote Procedure Platform (TAD) electronic document management system.

This requirement is intended to determine its true date and the authority and integrity of the electronic document.

If parties do not have a digital signature, they can celebrate a purchase or sale ticket through state notary interference.

In this case, the notary is the one who has to submit it through the Federal Property Real Estate Registry using a digital signature using the Distance Testing Platform (TAD).
