JOHANNESBURG – The Democratic Alliance (DA) says it "takes note of" the decision of the National Prosecutor's Office (NPA) to provisionally cancel the case against the defendants in Estina's fraud case, but the opposition party claims that the reasons are "easy at best and completely unconvincing."
In response to a Wednesday announcement that the R250 million Esthe dairy product fraud is being temporarily canceled, DA said it would work with Dr Silva Ramaite, Director of the State Prosecutor's Office.

The matter was to be considered again in the court next week, but the NPA has indicated that the K250 million fraud is being temporarily canceled because it failed to complete the investigation.
The accused, including the former CEO of Oakbay Nazeem Howa, Varun Gupta, brother of Brother Gupta's brother, former Sahara Computers chief Ashu Chawla, Estan leader Kamal Vasram, and three officials from the provincial government, Peter Thabethe, Sylvia Dlamini and Takisi Masiteng, were faced with allegations of fraud, theft , a conspiracy to commit fraud and theft.
They were also charged with violating the Law on Public Financial Management in violation of the Company Law and in violation of the Organized Crime Prevention Division.
The indications are that the fees will be reduced on Tuesday when the accused will appear in the Bloemfontein Magistrate's Court.

The move is focused on criticism from the DA, which blamed the lack of skills for the NPA to fail to complete the investigation.
"The NPA has no judicial accounting ability and it has never been," said Glynnis Breytenbach, a DA Member who shadowed the Minister of Justice.
Brettainbach, former NPA Senior Prosecutor, added: "This function is always entrusted with outsourcing to private companies, the SAPS [SA Police Service]. This is a SAPS function. National seizure is a crime against the people of South Africa.

"Estina's case is a particularly good example of how this phenomenon affects the most vulnerable in society.
"Gupta's family and their collaborators who are still in the ANC's parliamentary solos have literally stolen the poor in this case to give the rich and equalize the pockets of people who are politically linked to the ANC.
"Allowing those involved to avoid this will be even more a crime, and this will trigger a message that South Africa is a country where there is no responsibility for a strong and related political elite and no reward for those who do not have financial muscle to be tried alone."
